Authority for the proposition that:-

in cases involving the transfer of an undertaking, the question of whether an employee was employed "immediately before" the transfer depends on the particular circumstances of each case.

editor's note: the position in regard to this matter was later definitively decided by the House of Lords in Litster v Forth Dry Dock and Engineering Co Ltd 1989 ICR 341.
