BASIC POSITION

The purpose of the Sex Discrimination (Election Candidates) Act 2002 is to make it lawful to have women-only shortlists at political elections, a practice which an industrial tribunal had ruled in 1996 to be unlawful sex-discrimination under then current law (see Jepson v Labour Party [1996] IRLR 116 and see notes in this program on Sawyer and Others v. Ahsan 2000 ICR 1, EAT for the analagous position under the race discrimination legislation).
