    BASIC POSITION

    With effect from 30th September 2002 the Social Security (Jobcentre Plus Interviews) Regulations 2002 SI 2002/1703 impose a requirement on persons who claim, or are entitled to, certain social security benefits to take part in a work focused interview ("an interview").

    The benefits concerned are income support, incapacity benefit, invalid care allowance, severe disablement allowance and in some circumstances bereavement benefit (Social Security (Jobcentre Plus Interviews) Regulations 2002 SI 2002/1703, reg 2).

    Other regulations replace SI 2002/1703 for those who claim incapacity benefit, income support on the grounds of incapacity, income support whilst they are appealing against a decision which embodies a determination that they are not incapable of work, or severe disablement allowance. The other regulations, which also require such people to take part in work-focused interviews are the Social Security (Incapacity Benefit Work-focused Interviews) Regulations 2003, SI 2003/2439 , as amended and extended by the Social Security (Incapacity Benefit Work-focused Interviews) Amendment Regulations 2005, SI 2005/3 and the Social Security (Incapacity Benefit Work-focused Interviews) Amendment (No. 2) Regulations 2005, SI 2005/2604 and the Social Security (Incapacity Benefit Work-focused Interviews) Amendment Regulations 2006, SI 2006/536.
