Authority for the proposition that:-

in assessing fines to be imposed on both a small director owned company and its directors personally for breach of the Health & Safety at Work etc Act 1974 courts must be alert to ensure that they do not in effect impose a double punishment on the directors while at the same time making it clear that directors cannot simply shuffle their personal responsibilities off to the company.
