NOTES

  • The Human Rights Act 1998 (Making of Remedial Orders) Amendment Bill was introduced in the House of Lords by Lord Lester on 1st March 2004.
  • The Bill moved to the House of Commons on 5th May 2004. 2nd reading in the House of Commons was set for 15th October 2004 (having been twice postponed - on 18th June 2004 and 16th July 2004) but the Bill was then dropped.


    The purpose of this short (2 clause) Bill is simply to shorten the "remedial order process" under Human Rights Act 1998 s.10 and sch.2 under which the higher courts (but not employment tribunals or the EAT) have power to declare that a provision of primary or subordinate legislation is incompatible with the European Convention on Human Rights.
