  • ERA 1996 s.34 is entitled "Complaints to Employment Tribunal".
  • ERA 1996 s.205 is entitled "Remedy for infringement of certain rights"

    There is a three month time-limit for presentation of complaints re non or under payment of a guarantee payment. Complaints must be made to an Employment Tribunal (and nowhere else - ERA 1996 s.34 and ERA 1996 s.205).

    An ACAS conciliation officer will be involved (ETA 1996 s.18(1)(d)).
