Where the appropriate date (defined as the day in respect of whch the payment is due) falls on or after 1st February 2011 the delay limit for calculation of guarantee pay is £22.20 (previously, until 31st January 2011, £21.20). The increase is effected by the The Employment Rights (Increase of Limits) Order 2010 .

There is a limit of five days in any period of three months for which guarantee payment is payable (ERA 1996 s.31(2)-(7)).
