    BASIC POSITION

    There is a set form of questionnaire which an aggrieved person can use to ask questions of someone who he believes has discriminated against him (see schedules to the Race Relations (Questions and Replies) Order 1977, SI 1977/842).

    Time-limits relating to use of the questionnaire in Tribunal proceedings are set out at regs 4 and 5 of SI 1977/842 (see notes at time-limits/for various applications to Employment Tribunals/racial discrimination claims ).

    In early 1998, the Court of Appeal set out guidelines for handling of race discrimination cases by Employment Tribunals (see Martins v Marks and Spencer plc [1997] EWCA Civ 3067.
