    BASIC POSITION

CAUTION: go to notes on Equality Act 2010/changes made by the Act for changes to discrimination law in effect from 1st October 2010. The unique emplaw EA 2010 cross-reference tool will locate new statutory references for you.

An employee who has completed one month's continuous employment and who is suspended from work on certain safety related medical grounds is entitled to remuneration from his employer during the suspension period, up to 26 weeks maximum. At present the relevant grounds concern exposure to ionising radiation, lead and certain other substances which are hazardous to health.

Unless entitled to a greater amount under his or her employment contract the amount to which the employee will be entitled per week is a week's pay. This is the same as "a week's pay" in unfair dismissal and redundancy cases but with the important difference that there is no maximum "cap".

There is a useful Directgov website page on "Suspension from work on medical/health and safety grounds".

See also notes at Maternity/suspension by reason of pregnancy or maternity .
