An 18 year old hairdresser worked 38 hours a week for a total wage of £58. When the National Minimum Wage came into force on 1st April 1999 the employer should have increased the wage to £3 per hour, viz £114 per week for the same number of hours but felt unable to afford this. Therefore instead the girl's hours were cut to 20 per week and her wage increased to just £60.
The girl resigned and claimed constructive unfair dismissal. She won her case before the Liverpool Industrial Tribunal.
