    BASIC POSITION

CAUTION: go to notes on Equality Act 2010/changes made by the Act for changes to discrimination law in effect from 1st October 2010. The unique emplaw EA 2010 cross-reference tool will locate new statutory references for you.

The Children and Young Persons Act 1963 s.37 prohibits a child from taking part in specified types of performances and sporting and modelling activities without a licence from the local authority (see Children and young persons/child actors/a general note ).

Licences are granted subject to such "restrictions and conditions as the Secretary of State may by regulations made by statutory instrument prescribe" (C&YPA 1963, s.37(4)).

Regulations have been made setting out in considerable detail the conditions etc which must be included in licences.
