where an employee is summarily dismissed and his appeal under the employer's internal appeal procedure succeeds he is reinstated with retrospective effect but if his internal appeal fails then in the absence of express contractual provision to the contrary the dismissal takes effect from the original date when notice of immediate dismissal was given.
