a commercial arrangment entered into between an ex-employee and ex-employer following dismissal does not make the issuing of proceedings by the ex-employee against the ex-employer "not reasonably practicable" and so does not justify an extension of time for issuing proceedings - an objective (not subjective) test must be applied in deciding whether an excuse for being out of time satisfies the "not reasonably practicable" test.
