Representation:
where a cleaning company employs staff who clean a client's premises and one of the staff is injured as a result of a defect in an item belonging to the client, all the circumstances must be taken into account in assessing apportionment of damages between the employer and the employer's client and in particular there is no automatic rule that in those circumstances the employer's client should have the major share of the liability.
