in personal injury cases (not strictly within the ambit of this employment law program) the rule is that if statutory compensation is payable (for example under the Pneumoconiosis etc. (Workers' Compensation) Act 1979) then that statutory compensation must be deducted from any damages for negligence, regardless of whether those damages are in respect of financial loss or are for pain and suffering and loss of amenity
