Authority for the propositions that:-
(i) in litigation cases a solicitor who agrees an unreasonable conditional fee arrangement ("CFA") with his client will not be able to recover the full amount of his fee from the losing side;
(ii) a successful claimant will be able to recover from the losing side any reasonable premium for after the event ("ATE") insurance (ie insurance taken out to cover the risk of incurring a liability by starting legal proceedings which are later lost) and this is so even if the insurance was taken out prior to any "letter before action" being written.
