Representation:
forceful and intimidating letters sent by an employer to a group of employees claiming equal pay with a view to persuading them to drop their claims can amount to unlawful victimisation contrary to Sex Discrimination Act 1975 s.4. In considering whether there has been unlawful "victimisation" the proper test is to consider the matter from the point of view of the employees who have allegedly been victimised rather than to focus (as the Court of Appeal had done) on whether the employer had acted "honestly and reasonably".
