Representation:-
for the purposes of the Fixed-Term Employees (Prevention of Less Favourable Treatment) Regulations 2002, SI 2002/2034 the date of the act complained of was not the date on which a policy was decided in principle but was when the detailed application of the policy was decided.
In this case the result was that fixed-term employees were able to use the 2002 Regulations to claim a bonus which their employer had decided should be paid only to "permanent" staff even though those regulations were not in force at the time when the employer had decided in principle on its bonus policy.
