a claim by a former employee that he was dismissed for complaining about unauthorised deductions from wages contrary to Employment Rights Act 1996 s.13 and for threatening to commence proceedings in an employment tribunal is an assertion of a statutory right within the meaning of Employment Rights Act 1996 s.104(4)(c) with the result that if the claim is proved, the dismissal will be automatically unfair.
