where a teacher applies for and receives ill-health retirement benefit under the Teachers' Pensions Regulations 1997, SI 1997/3001 on the ground of permanent incapacity, the employer is not under a public law duty to serve notice of termination of employment (which would trigger an entitlement to notice pay under the teachers' standard-form Conditions of Employment known as the "Burgundy Book").
