    BASIC POSITION

CAUTION: go to notes on Equality Act 2010/changes made by the Act for changes to discrimination law in effect from 1st October 2010. The unique emplaw EA 2010 cross-reference tool will locate new statutory references for you.

This simple 2 clause Act provides for 30th November (if it is not a Saturday or Sunday or, if it is a Saturday or Sunday, the following Monday) to be a Bank Holiday in Scotland. This is done by simple amendment to the Banking and Financial Dealings Act 1971.

The Act does not give workers a legal right to have an extra day off work. As a 2006/09/12 Scottish Executive Press Release re St Andrew's Day Bank Holiday (Scotland) Bill pointed out, the Bill "will not give anyone an automatic right to an additional day's holiday..... This Bill is aspirational, it seeks to improve our celebration of St Andrew's day and it seeks to encourage more people to enjoy a holiday whilst engaging in those celebrations".

See also notes at Holidays/public and bank holidays and/or at Bills before Parliament/Archive (2002 onwards)/2006 St George's Day Bill .
