the tribunal's discretion to review a default judgment under rule 33 of the Employment Tribunals Rules of Procedure 2004 is a broad just and equitable one. The tribunal must first, and always, consider whether there was good reason for the response not having been presented within the time limit, but must also take into account all other relevant factors including the reasonable prospects of success.
For relevant general notes see Procedure of Employment Tribunals/review of tribunal decisions and/or Procedure of Employment Tribunals/2004 rules/rule 04 - responding to the claim and/or Procedure of Employment Tribunals/2004 rules/rule 33 - review of default judgments .
