    1. an employer who has not responded to an employee's claim in employment tribunal proceedings and who has taken no part in the proceedings can nevertheless appeal to the EAT against the tribunal's decision; and
    2. an award for financial loss suffered as a result of disability discrimination should be discounted to reflect payments made to an employee under his employer's permanent health insurance scheme.
