Authority for the propositions that:-
- a trade union official is entitled to compensation for breach of his statutory right to time off for trade union duties, whether or not he has suffered financial or other loss, and
- in defining a 'disciplinary hearing' it is crucial to consider the nature of the meeting itself rather than the description the parties give it and/or its possible consequences.
For relevant general notes see Trade union matters/time off for official union duties and/or Unfair dismissal /automatically unfair dismissals /right to be accompanied at disciplinary or grievance hearing .
