    BASIC POSITION

    This Act as passed differs in a major way from the Bill as introduced. The original version would have prohibited the opening of large shops on Christmas Day and New Year’s Day for the purpose of retail trading. Only Christmas Day trading is banned under the Bill as passed. Nevetheless the phrase "New Year's Day" still appears in its title - unlike in the similar English and Welsh Act (see Acts of Parliament etc/Christmas Day Trading Act 2004 ).

    Although New Year's Day has been removed from the immediate operation of the Bill, Scottish Ministers are given power to extend the prohibition to cover New Year’s Day by order, but only if approved by the Scottish Parliament.
