Authority for the propositions that:-
- an award of compensation for "loss of statutory rights" is usually a nominal award of £250 to compensate a claimant for being without protection from unfair dismissal for the first year of any new employment he finds (see Unfair dismissal/qualifying period/normal cases ). If an Employment Tribunal makes an award of more than £250 for "loss of statutory rights" it must express its reasoning clearly and set out the evidence available to support it.
- where an unfairly dismissed employee had long service it is possible in exceptional cases for compensation awarded to him to include some amount for "loss of the right to long notice" (as to which see Notice periods/by employer ).
