Representation:
there is no free-standing right for an employee to bring a claim that his employer failed to follow the statutory disciplinary/dismissal procedures required since 1st October 2004. Therefore a dismissed employee who is unable to claim unfair dismissal because he had not completed the period of continuous employment required bring such a claim (one year) cannot instead bring a claim that his employer failed to follow the statutory disciplinary/dismissal procedures.
