Authority for the proposition that:-

it is legitimate for an Enhanced Criminal Records Certificate to include details of conduct which, even if proved, would not actually constitute a criminal offence. The rules in Police Act 1997 s.115(7) should not be applied so as to restrict information provided by the police only to details of criminal activity.
