On 9th December 2004, the second anniversary of the introduction of the 2002 EAT rules of procedure, a new 2004 EAT practice direction was handed down. It came into force at once and replaced the 2002 practice direction (as to which see Employment Appeal Tribunal/2002 Practice Direction on procedure ).

The 2004 Practice Direction makes changes to reflect the 2004 EAT rules of procedure (see notes at Employment Appeal Tribunal/rules of procedure ).

At the same time as issuing new EAT practice directions, the EAT President also issued, with approval of ACAS , a trial formal "EAT Conciliation Protocol" to deal with para 11 matters (see Employment Appeal Tribunal/2004 Practice Direction on procedure/11 Complaints about the conduct of the Employment Tribunal hearing and notes at Employment Appeal Tribunal/bias and conciliation protocol ).
