EAT on 10th August 2007, reported at [2007] IRLR 847
the EAT confirmed that a company director and majority shareholder may also be an employee of the company and as such is entitled to claim under the employment protection legislation unless the company itself is found by the tribunal to be a 'mere simulacrum' and that by the same token the contract between it and the individual concerned is a sham.
