Representation:
although an employer who has given notice of dismissal to an employee cannot unilaterally withdraw it, if the employee invokes an internal appeal procedure in response to being given notice he is thereby taken to have consented to the employer withdrawing the notice. Therefore if in those circumstances the employer does withdraw the notice the employee cannot subsequently claim that he had been dismissed by that notice (and therefore by definition cannot succed in a claim of unfair dismissal).
