it is an unlawful restriction forbidden by Art 49 EC (freedom to provide services) for a public authority to be required by statute to award contracts - in this case contracts for building services - only to companies which undertake to pay workers from other Member States at least the remuneration prescribed for their own nationals by a local collective agreement.
