An example of a case in which:-
- an employer's refusal to allow a previously full time female employee to return to work part time after maternity leave was found to be unlawful sex discrimination;
- an employee's resignation was not constructive dismissal even though the the employer had been "guilty" of unlawful sex discrimination as, on the facts, the tribunal was not satisfied that that was the reason for her resignation. .
