the House of Lord's 2008 ruling in the Housing Law case of London Borough of Lewisham v Malcolm HL 2008 IRLR 700 (to the effect that the correct comparator in a disability-related discrimination case is a non-disabled colleague of the claimant who is the same circumstances as him) applies also in employment cases.
