Authority for the propositions that:-
- justice is paramount and therefore a rigid legalistic interpretation of the employment tribunals' rules of procedure by employment tribunals in a way which might not serve the interests of justice should be discouraged; and in particular
- a claim form which identifies an alleged breach of a statutory right within the employment tribunal's jurisdiction must be treated as containing sufficient details of the claim with the result that it must be accepted by the tribunal even if it does not conform in every detail with the requirements of the rules of procedure.
