where a party to a contract is entitled to determine the contract if the other party were to be convicted of any serious criminal offence, determination can be triggered where guilt is established after the date of the agreement although the conduct in question had taken place earlier.
and an example of a case in which
a clause in a consultant's contract under which he could be dismissed if he was convicted of any serious criminal offence or otherwise be guilty of conduct of conduct tending to bring the "employer" into disrepute entitled the "employer" to dismiss him where the misconduct had taken place before the date of the contract even though guilt was not established until later.
