  • Employment Rights (Dispute Resolution) Act 1998 s.11 is entitled "Settlements of redundancy cases".

    Technically, until 1st October 1998, ACAS conciliation officers did not have power to conciliate in     Redundancy pay disputes. With effect from 1st October 1998 Employment Rights (Dispute Resolution) Act 1998 s.11 gave them this power (and duty) - see Acts of Parliament etc/Employment Rights (Dispute Resolution) Act 1998/Commencement dates .

    The section also ensures that in the event of an employer being unable to pay an amount arrived at in settlement of a statutory redundancy pay dispute because of insolvency, the government guarantee of the settlement amount will be fully valid (see Insolvency/government guarantees on insolvency of employer/redundancy money ).
