    NOTES

    Employment Rights (Dispute Resolution) Act 1998 s.6 is entitled "Jurisdiction in cases about political fund contributions"



    A trade union cannot force a member to subscribe to its political fund (ERA 1996 s.65(2)(f) and ERA 1996 s.84) and an employee can require the employer not to deduct, or to cease deducting, "political fund contributions" from his wages even though other union dues are to be deducted (TULRCA 1992, s.86 and see Trade union matters/deduction of union dues from wages/political fund contributions ).

    Until 1st August 1998 if the employer did not comply the employee had first to obtain a declaration from the county court (in Scotland, the sheriff court) and then had three months within which to bring proceedings under ERA 1996 s.23 in an employment tribunal (see TULRCA 1992, ss.87 and 88(3) & (4) and TIME-LIMITS/for various applications to employment tribunals/union political fund deductions from wages ).

    This procedural anomaly has been removed by ERDRA 1998 s.6. A new replacement version of TULRCA 1992 s.87 gives the whole jusridiction to employment tribunals as from 1st August 1998 (see Acts of Parliament etc/Employment Rights (Dispute Resolution) Act 1998/Commencement dates ).
