• an unfair dismissal case in which an employment tribunal made an error of law by substituting its own view for that of the employer in deciding whether dismissal was within the range of reasonable responses open to an employer in the particular situation; and

• a case in which an employee failed in an attempt to claim that he had been dismissed for whistleblowing
