NOTES

  • Fisher v Hoopoe Finance Ltd EAT on 2nd June 2005

    Authority for the propositions that:-

    1. it is likely that a redundancy dismissal will amount to unfair dismissal if the employer fails to provide the employee concerned with full information (including salary levels if known) about alternative jobs within the same group but the employee's failure to express interest or to request further information can then be a factor to be taken into account to reduce compensatory award on grounds of contributory fault.

    2. if an employment tribunal has provided reasons for its decision in the manner required by the relevant rules of procedure, then (unless it is shown to have been biased or incompetent) it's decision cannot be overruled on the basis that inadequate reasons were given.
