a non-human defendant such as a company cannot be convicted of manslaughter by gross negligence in the absence of evidence establishing the guilt of an identified human individual for the same crime but that does not mean there has to be evidence as to the individual's state of mind since a human individual can be guilty of manslaughter by gross negligence even in the absence of such evidence.
