    BASIC POSITION

CAUTION: go to notes on Equality Act 2010/changes made by the Act for changes to discrimination law in effect from 1st October 2010. The unique emplaw EA 2010 cross-reference tool will locate new statutory references for you.

Tier 5 was introduced at the same time as Tier 2 in November 2008 and has replaced a number of varying visa categories under the header of 'Temporary Workers'. Like Tier 2, individuals applying under this Tier must have a sponsor who supports this application. However, some Tier 5 sub categories differ from Tier 2 in the way this sponsorship is implemented.

Tier 5 consists of the following Visa categories:

  • Tier 5 (Youth Mobility Scheme)
  • Tier 5 (Creative and Sporting)
  • Tier 5 (Charity Workers)
  • Tier 5 (Religious Workers)
  • Tier 5 (Government Authorised Exchange)
  • Tier 5 (International Agreement) (the General Agreement on Trade in Services (GATS); Similar agreements between the United Kingdom and another country; Employees of overseas governments and international organisations; and Private servants in diplomatic households.
