When using the Employment Judges' "Pension Rights guidelines" to assess pension loss following a finding of unfair dismissal if the employee has a long period of service and has reached an age where they are less likely to be looking for a new job a Tribunal should generally use the 'substantial' approach (as opposed to the 'simplified' approach) set out in those guidelines.
