Tim Arrow & Sons v Onley - uplift in unfair dismissal compensation for procedural failure is potentially avoidable by employers

The percentage uplift to compensation which can be made in favour of an employee whose dismissal is unfair because the employer has not followed proper procedures applies only to "awards" actually made by an employment tribunal - so an employer can successfully avoid any uplift if, before the tribunal hearing, he pays to the employee a sum sufficient to reduce the award to nil (and pro rata if a smaller amount is paid).
