Key Points

  • Trade union recognition is a formal status given to a trade union which enables the trade union to negotiate in relation to the pay, hours and holidays of all workers or a defined set of workers (known as a “bargaining unit”). 
  • A trade union can achieve recognition by following a statutory procedure set out in Schedule A1 to TULRCA, which commences with an initial request from the trade union.
  • Recognition can either be voluntary by agreement between the employer and the trade union, or compulsory, by order of the Central Arbitration Committee.
