(1) Unison (2) GMB v (1) Brennan & ors (2) Sunderland City Council - Tribunals have jurisdiction to declare terms of collective agreement void, even where those terms can otherwise be challenged under the Equal Pay Act [2008] EAT

Mrs Brennan and others brought Equal Pay Act claims against their employer Sunderland CC. They also claimed, against Sunderland and two trade unions, that certain provisions of a collective agreement (the Phase One Single Status Agreement - POSSA) were void under Sex Discrimination Act 1975 s.77. Sunderland wanted to rely on it for its genuine material factor (GMF) defence to the equal pay claims.
