Abbey v Associated Foreign Exchange Ltd & others - effective date of termination is a purely statutory concept
Mr Abbey claimed unfair dismissal. In the context of a challenge as to whether his claim was brought within the three-month time limit, an employment judge ruled on the disputed effective date of termination (EDT) of employment, under Employment Rights Act 1996 sec 97(1)(b). The employer said that Mr Abbey's employment ended on 29 January 2008: he contended for a later date, since otherwise his claim would be out of time
