Abellio London Ltd (Formerly Travel London Ltd) v Musse & Ors - Changed base of work material detriment under TUPE [2012] EAT

Tribunal was entitled to conclude that there had been a substantial change in working conditions, amounting to a material detriment to claimant bus drivers, when their base of work changed from Westbourne Park to Battersea following a TUPE transfer.

Five employees working for CentreWest were employed as bus drivers on the 414 route operating from the Westbourne Park depot. Their contracts stated that during training they could be allocated any work location; on completion of training the company would endeavour to accommodate their preferred work location; after six months’ service the drivers could apply to a transfer to a ‘more residentially suitable location’. A list of locations provided did not include Battersea.
