Accurist Watches Ltd v Wadher - No absolute requirement for witness evidence to support application for time extension [2009] EAT

Mr Wadher brought a claim of age discrimination, based upon an alleged failure by Accurist to provide him with his full, contractual hours' worth of work. His claim under the Employment Equality (Age) Regulations 2006 was presented to the Employment Tribunal five weeks outside of the statutory deadline, even allowing for a three month extension by virtue of the Employment Act 2002 (Dispute Resolution) Regulations 2004 reg 15. An employment judge concluded that it was just and equitable, under the 2006 Regulations Reg 42(3), to extend time.
