Adecco UK Ltd v Ali - Race discrimination and burden of proof [2007] EAT
The EAT has ordered a rehearing of this case in which Ms Ali had won £8,400 in a race discrimination claim against the Adecco employment agency. She had worn a Muslim veil when being interviewed. Adecco appealed against the finding of race discrimination and won (to the extent that a rehearing was ordered) because the original tribunal had failed to make an essential finding of fact - whether the post in question had already been filled when Ms Ali was interviewed.
